Creditor Harassment

Stop Creditor Harassment

Colorado Springs and Pueblo Bankruptcy Attorney

  • Do your financial problems require legal help?
  • Are creditors constantly calling you?
  • Has creditor harassment become an upsetting part of your life?

Being in debt and owing money is difficult and stressful enough without having to deal with harassing creditor calls. Is there anything comparable to the absurd attitude and discourteous and insulting words and language some collectors use when trying to collect debt? How does any collector think they have the right to speak to another person the way they may be speaking to you? Well, they don't have the right BUT you have the power, through the bankruptcy laws, to prevent this abuse.

Though creditor harassment is an unpleasant experience for any individual, there are avenues through which we at the law offices of John A. McLaughlin Jr., P.C., can help stop the harassing phone calls and contacts from creditors and collection agencies.

We strongly believe in educating our clients so that they know their rights and are able to exercise them. It is important to us that clients are able to find the relief that they are searching for when coming to our firm. Working closely with clients, we can take charge of debts and pursue an end to the harassment you and your family may be experiencing. You have rights and options for dealing with creditor harassment. Do not let creditor and collection agency harassment continue.

Stop Creditors From Calling

After you have filed Chapter 7 or Chapter 13 bankruptcy, your creditors will receive notice of the filing. Once this notice is received, an automatic stay is put into effect. This means that your creditors are barred from taking actions against you that are an attempt to collect money from you. When meeting with us at the law offices of John A. McLaughlin Jr., P.C., we will explain in detail how the stay may affect your specific situation.

The Fair Debt Collection Practices Act (FDCPA) has set up some specific guidelines by which creditors and collections agencies must abide. More importantly, however, the automatic stay that is put in place by your bankruptcy filing prohibits many actions including:

  • Calling your home or workplace
  • Sending threatening letters
  • Continuing to mail bills
  • Home foreclosure
  • Wage garnishment
